Welcome to lawniix.com (the "Site"), operated by Bilel Khabouri / Lawniix ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Site and any purchase of robotic lawn mowers, accessories, and spare parts made through it. By accessing the Site or placing an order, you agree to these Terms. These Terms should be read together with our Legal Notice, Terms of Sale, Return & Refund Policy, Shipping Policy, and Privacy Policy.

1. Eligibility
You must be at least 18 years old, or the age of majority in your state of residence, and have the legal capacity to enter into a binding contract, to use the Site or place an order.

2. Products, Descriptions & Pricing
- We make reasonable efforts to display accurate descriptions, specifications, and images of our robotic lawn mowers; minor variations (color, packaging) may occur.
- All prices are listed in US dollars (USD). Applicable taxes and shipping costs are itemized and displayed before you complete payment. Any import duties or customs fees that may apply to your delivery are described in our Shipping Policy.
- If a pricing or typographical error occurs, we reserve the right to correct it, cancel the affected order, and issue a full refund. We will contact you before charging any corrected amount.
- We may limit order quantities or refuse an order at our discretion, including in cases of suspected fraud or reseller/bulk activity.

3. Orders & Payment
- Placing an order is an offer to purchase; a contract is formed only when we send you an order or shipping confirmation.
- We accept the payment methods displayed at checkout. All transactions are processed over a secure, encrypted (HTTPS) connection.
- You represent that any payment information you provide is accurate and that you are authorized to use the chosen payment method.

4. Shipping & Delivery
Shipping timeframes, carriers, and costs are set out in our Shipping Policy. In accordance with the FTC's Mail, Internet, or Telephone Order Merchandise Rule (16 C.F.R. Part 435), if we cannot ship your order within the timeframe stated at checkout (or within 30 days if none was stated), we will notify you and either obtain your consent to the delay or issue a prompt refund for the unshipped merchandise.

5. Returns, Refunds & Cancellations
Returns, refunds, and order cancellations are governed by our Return & Refund Policy, which forms part of these Terms.

6. Product Warranties
Robotic lawn mowers sold on the Site are covered by the manufacturer's written warranty; its terms, duration, and claims process are set out in the documentation provided with the product. To the extent permitted by applicable law, we disclaim implied warranties (such as merchantability or fitness for a particular purpose) beyond what the manufacturer's warranty or applicable law provides. Nothing in these Terms limits any warranty rights that cannot be waived under federal or state law, including the Magnuson-Moss Warranty Act (15 U.S.C. §§ 2301-2312).

7. Intellectual Property
All content on the Site, including text, product descriptions, images, logos, and design, is owned by Bilel Khabouri / Lawniix or its licensors and protected by copyright and trademark law. We grant you a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial shopping purposes. No content may be copied, reproduced, or used commercially without our prior written consent.

8. Acceptable Use
When using the Site, you agree not to:
- Violate any applicable law or regulation
- Use bots, scrapers, or automated tools to access or extract data from the Site
- Interfere with the Site's security, availability, or normal operation
- Submit false, fraudulent, or misleading information, including at checkout
- Infringe our intellectual property or that of any third party

9. Accounts
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@lawniix.com of any unauthorized use.

10. Third-Party Links
The Site may link to third-party websites (e.g., payment processors, carriers) that we do not control. We are not responsible for the content, policies, or practices of any third-party site.

11. Disclaimer of Warranties (Website)
The Site is provided "as is" and "as available." To the extent permitted by law, we disclaim all warranties, express or implied, regarding the Site's operation, including that it will be uninterrupted, secure, or error-free.

12. Limitation of Liability
To the fullest extent permitted by law, Bilel Khabouri / Lawniix will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Site or products purchased through it. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim. Nothing in these Terms limits liability that cannot be excluded under applicable law.

13. Indemnification
You agree to indemnify and hold us harmless from claims, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site.

14. Governing Law & Dispute Resolution
- These Terms are governed by the laws of France, without regard to conflict-of-law principles, and without prejudice to any mandatory consumer protection rights available under the law of your state of residence.
- Before filing a claim, you agree to contact us at support@lawniix.com so we can try to resolve the dispute informally.
- Any dispute that cannot be resolved informally will be settled by binding arbitration under the Federal Arbitration Act, administered by the American Arbitration Association under its Consumer Arbitration Rules, on an individual basis only (no class actions), except that either party may bring an individual claim in small claims court. You may opt out of this arbitration clause by notifying us in writing within 30 days of first accepting these Terms.

15. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

16. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will stay in full force and effect.
